These Terms of Service ("Terms") govern your use of Imagemakers (the "Platform," "we," "us"). By creating an account or using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
You must be at least 18 years old and working in or connected to the on-set production industry to join. Membership is granted through a referral-and-vouch process at our sole discretion; we may deny, suspend, or revoke membership at any time for any reason.
Imagemakers is a venue that lets members connect with each other — through a forum, a job/gig board, a peer-to-peer marketplace, and portfolio critique sessions. We do not verify the identity, qualifications, work history, or claims of any member, and we do not verify the accuracy of any post, job listing, marketplace listing, or critique session. We are not a party to, and have no responsibility for, any agreement, transaction, sale, hire, or interaction between members. This includes the forum's Client ChitChat category: posts there are one member's account of their own payment experience with a client, and any "confirmed by" count reflects other members saying they had a similar experience — it is not verification, investigation, or fact-checking by Imagemakers, and we make no representation about the accuracy of any claim made there.
The gig board is a place for members to post and respond to hiring and availability listings. Imagemakers is not an employer, staffing agency, or party to any hiring arrangement. Rate, scope, payment terms, and working conditions are negotiated entirely between the members involved. We do not guarantee that any hiring member will pay, or that any hired member will perform, as agreed.
Sell Gear lets members list gear for sale to other members. All sales are strictly between the buyer and seller. Imagemakers never processes, holds, or has any involvement in payment for any sale, and takes no fee on these transactions at this time. We do not guarantee the condition, accuracy, legality, or existence of any item listed, and we are not responsible for any dispute, non-payment, non-delivery, or defect arising from a sale.
Membership requires vouches from existing members. A vouch is a social statement by one member about another — it is not a background check, identity verification, safety certification, or guarantee of any kind by Imagemakers or by the vouching member. Do not rely on a vouch, or on a member's status, badge, or reputation score, as confirmation that another member is safe, competent, or trustworthy.
Using the gig board, marketplace, or Call Sheet may lead to meeting other members in person for work, gear pickup, or other purposes. You do this entirely at your own risk. We strongly encourage ordinary precautions — meeting in public or well-lit locations, telling someone where you're going, and trusting your judgment. Imagemakers has no responsibility for anything that happens during or as a result of an in-person interaction between members.
Members are solely responsible for anything they post — forum posts, comments, listings, gig descriptions, profile content, and messages ("User Content"). We do not pre-screen User Content for accuracy, and posting or displaying User Content does not mean we endorse it. You can report content you believe violates our Code of Conduct or these Terms through Contact Mods or the in-app report tools. We may remove any content, or take action against any account, at our sole discretion and without prior notice. Mods do their best to work with members to bring a post into compliance with our posting rules before it goes live, but this is a courtesy, not an obligation — we are not liable for any post that is delayed, declined, or removed.
All members must follow our Code of Conduct. Violations may result in a warning, temporary suspension, or permanent removal from Imagemakers, at our sole discretion.
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THE CONDUCT, IDENTITY, OR RELIABILITY OF ANY MEMBER.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMAGEMAKERS AND ITS ADMINS AND MODERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE PLATFORM OR ANY INTERACTION, TRANSACTION, OR DISPUTE WITH ANOTHER MEMBER — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THE PLATFORM WILL NOT EXCEED FIFTY DOLLARS ($50).
You agree to indemnify and hold harmless Imagemakers and its admins and moderators from any claim, damage, loss, or expense (including reasonable legal fees) arising from your use of the Platform, your User Content, your violation of these Terms, or your interactions or transactions with other members.
We may suspend or terminate your access to the Platform at any time, for any reason, without notice. You may stop using the Platform at any time.
We may update these Terms from time to time. Continued use of the Platform after a change means you accept the updated Terms.
These Terms are governed by the laws of [STATE], without regard to conflict-of-law principles.
